NY Bill based on ASTM F2923-11 Passes Senate Unanimously
FJATA chaired the ASTM F15.24 Subcommittee that developed the F2923-11 Standard Specification for Consumer Product Safety for Children’s Jewelry. This document forms the foundation of NY S. 4055A (Alesi), a bill that would require manufacturers and importers to ensure that their products meet certain content limits in substrate and surface coatings. On March 6 of this year S. 4055A passed unanimously as it had last year. Once the companion bill, NY A. 6758A (Englebright), passes in the Assembly, NY will be the first state in the nation to have passed a children’s jewelry safety law that will meet broad industry support. The following standards are invoked by the bill:
- 300ppm cadmium in metal substrates with a migration option that must yield less than 200mcg
- 300ppm cadmium in plastic substrates with a migration option that must yield less than 75 mcg
- limits on heavy metal content in surface coatings as per ASTM F963
- if not a small part, metal and plastic components must not exceed 18mcg cadmium in a saline extraction test
- applies to products intended for children 12 and under
- effective date is one year after receiving the governor’s signature
